Council legal battle

WINGECARRIBEE Council’s legal representative, Piper Alderman, attended a directions hearing on Thursday to seek leave of the court to continue Federal Court proceedings in its action against Lehman Brothers Australia Limited.

Mayor Duncan Gair said representatives for Lehman Brothers sought an order to have the matter adjourned until June 5, 2009, which is after the second creditors meeting.

Representatives for the council asked the court to continue proceedings for the purpose of seeking production of the insurance contracts.

“His Honour Justice Rares, indicated that he is eager to expedite the Federal Court proceedings, which is very positive for our council,” Cr Gair said.

Justice Rares made five orders to give the parties an opportunity to make submissions on the proposed motion to seek leave.
