Councillor Jim Mauger challenges path policy

COUNCILLOR Jim Mauger and three of his Robertson neighbours are fighting Wingecarribee Council's demand for a $2000 per property contribution to a new footpath along the Illawarra Highway.

The payment has been sought under a footpath policy adopted in March, 2009, after Bundanoon residents objected to contributions sought for a path in Eridge Street.

Under its previous policy, Council could ask residents of adjoining properties to pay 50 per cent of the cost of footpaths and kerb and gutter.

The new policy allows Council to collect a maximum of $2000 each from residents.

But Cr Mauger yesterday described the policy as "unconscionable".

Cr Mauger said the contribution was an unfair imposition on four residents adjoining the path, while beneficiaries such as Fountaindale Grand Manor [Ranelagh House] and up to 40 other home owners with access to the path would pay nothing.

"I think it's unconscionable for us to give a donation of $2000 when you have got properties on the other side of the road that get off scot-free," he said.

Cr Mauger said he and his neighbours, including an 85-year-old woman, were unlikely to make use of the footpath.

"I'm battling to walk from the car into the council chambers, so how often do I walk into Robertson?"

Council last month agreed to pay Cr Mauger $2000 in compensation for access to his property, including construction of a compact earth batter (earth slope supporting the built-up footpath) within the boundary, and "inconvenience" during the work.

Council will also replace the fence and a gate along Cr Mauger's boundary.

But Cr Mauger has not signed the agreement to give Council permission to undertake the works, although Council has already fenced of an area of his property.

Cr Mauger said he believed no one in the shire should have to pay footpath contributions, especially since Wingecarribee Council had already increased rates by 9.5 per cent a year to fund infrastructure such as footpaths.

Council has deferred a decision on the footpath contribution until September 23 and will hold an information session in the meantime.

At Wednesday's meeting Cr Paul Tuddenham pointed out that residents along the shared cyclepath/walkway from Welby to Mittagong had not been asked to contribute toward a footpath because the safety of children was considered paramount.

Cr Tuddenham said he was concerned that Council's application of the policy was inconsistent and that the people who would contribute to the Robertson footpath were not the people who would benefit.

Cr Larry Whipper asked whether the $2000 maximum contribution under the new policy was too high.

A report to Council from director infrastructure services Michael Brearley stated that council staff had experienced problems in trying to implement the new policy on pathways, including time taken to respond to residents' complaints, delays to projects, and difficulties in negotiations between Council staff and affected property owners.

But Cr Jim Clark said that there was a need for footpaths in the shire.

"Even though it's a hard decision to make, I think we should stick to it."

Mayor Duncan Gair supported a motion that Council confirm its policy.

If Council changed its policy, it would create a perception that it was looking favourably at a request from a fellow councillor, he said.

"I do not accept a policy change in council chambers when it is about one of our colleagues," he said. "I think that is poor form."

Cr Gair said that residents in parts of the shire without footpaths subsidised those who did have access to a path.

Contributing towards a footpath was the least that property owners could do for a footpath outside their house, which increased their property valuation, he said.

"I won't change policy on the run."
